Onyx Sound Lab is operated by ROLAND PARTNER Sp. z o.o., d/b/a "Onyx Sound Lab" ("Onyx Sound Lab," "we," "us," "our").

The Services are intended for users in the United States. You must be at least 18 years old (or the age of majority in your state) to use the Services.

All content and communications provided through the Services (including audio tracks, articles, frequency recommendations, email, and SMS) are for general informational, educational, and entertainment purposes only.

• •Audio content labeled with frequency categories (e.g., "focus," "sleep," "relaxation") is based on general wellness concepts and is not clinically validated therapy.
• •Always consult a qualified clinician for personal medical questions and before starting, changing, or stopping any health routine, supplement, medication, or treatment.
• •If you believe you may have a medical emergency, call 911 or your local emergency number.

You agree to use the Services lawfully and respectfully. You agree not to:

• •Access or use the Services in a way that could disable, overburden, damage, or impair the Services
• •Attempt to gain unauthorized access to systems, accounts, or data
• •Scrape, harvest, or collect data from the Services without permission
• •Transmit malware or harmful code
• •Use the Services for unlawful, deceptive, abusive, or harmful purposes
• •Download, rip, or redistribute audio tracks outside of the platform
• •Circumvent streaming protections, DRM, or access controls on audio content
• •Use audio content for commercial purposes without authorization

This section applies if you opt in to receive SMS/text messages (the "SMS Program").

Audio content available through the Services is provided under Creative Commons licenses or other applicable licenses from third-party content providers (such as Jamendo). You may stream audio through our platform for personal, non-commercial use only.

Attribution to original artists is displayed on the platform as required by applicable licenses. We are not the copyright owner of third-party audio content and make no warranties regarding third-party content.

When you create an account (via Google Sign-In), we store your favorites, playlists, listening history, and Frequency Finder quiz results. You can delete your account and associated data at any time from your profile settings. See our Privacy Policy for details on data handling.

The Services may reference or link to third-party products, services, websites, or providers ("Third-Party Services").

• •Third-Party Services are provided by independent parties, not Onyx Sound Lab.
• •We do not control and are not responsible for Third-Party Services, including their content, availability, pricing, policies, or privacy practices.
• •Your use of Third-Party Services is governed by their terms and policies.

Some links or recommendations may be affiliate or referral-based, meaning we may earn compensation if you take action through those links. Where compensation is possible, we aim to disclose material connections clearly.

The Services, including content, design, text, graphics, logos, and trademarks, are owned by Onyx Sound Lab or licensed to us and are protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial use. You may not reproduce, distribute, publicly display, sell, or create derivative works from our content without written permission, except as allowed by law.

If you submit suggestions, ideas, questions, or feedback, you grant Onyx Sound Lab a worldwide, royalty-free license to use them to operate and improve the Services, without compensation, unless prohibited by law. Do not submit confidential information.

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• •ONYX SOUND LAB WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
• •ONYX SOUND LAB'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (IF ANY).

Some states do not allow certain limitations, so portions of this section may not apply to you.

You agree to defend, indemnify, and hold harmless Onyx Sound Lab and its affiliates, officers, directors, employees, and agents from claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your violation of any law or third-party rights.

We may modify the Services or update these Terms at any time. We will update the "Last updated" date above or provide additional notice where required. Continued use after changes means you accept the updated Terms.

These Terms and the Privacy Policy constitute the entire agreement regarding the Services. If any provision is unenforceable, the remaining provisions remain in effect.
